Employment laws and regulations in Rwanda

When hiring in Rwanda, it is essential to be aware of the employment laws and regulations governing the local labor market. In Rwanda, employment contracts are typically drafted in Kinyarwanda, French, or English, based on the preference of the parties involved. Ensuring that your employment contracts adhere to local best practices is crucial for a successful and compliant recruitment process.

Employee probation periods in Rwanda are permissible for up to six months. This allows employers to assess new hires’ performance and suitability for the role before confirming their employment.

Rwanda follows a 45-hour work week, with overtime calculated for hours exceeding the weekly legal working hours (45 hours) or contractual working hours (if agreed as less than 45 hours per week). Overtime premium pay is based on the employee’s basic salary, excluding allowances and other benefits. The modalities for extra hours and the rate of remuneration for overtime are determined under a collective labor convention, which must be revised annually.

Employment termination in Rwanda

Understanding the policies surrounding employment termination in Rwanda is crucial for maintaining compliance and fostering a positive work environment. Indefinite term contracts may be terminated for just cause, and written notice should be given to the employee, except if dismissal is due to serious misconduct.

The notice requirements for termination are as follows:

  • Less than one year of service: 15 days’ notice
  • Greater than one year of service: one-month notice

 

Employees are generally entitled to severance pay after completing one year of service. 

Severance pay is awarded according to the following guidelines:

  • Less than five years of service: one month’s salary
  • Five to 10 years of service: two months’ salary
  • 10-15 years’ service: three months’ salary
  • 15-20 years’ service: four months’ salary
  • 20-25 years’ service: five months’ salary
  • 25+ years’ service: six months’ salary
