Terminating employment contracts requires careful consideration of the legal framework in Comoros. In Comoros, you have the right to terminate an employee’s service if there is a valid reason related to their conduct or capacity to handle operations. However, it is important to note that termination based on factors such as trade union activity or membership, nationality, color, race, social origin, gender, family responsibilities, pregnancy, marital status, religion, political opinion, or exercising a mandate to represent workers is strictly prohibited.

Additionally, absences for maternity leave, illness, or accidents certified by a physician cannot be grounds for termination.

When terminating an employee’s service without notice or before the period of notice has ended, you are required to provide remuneration for any salary and benefits the employee would have received for the remainder of the notice period. Severance and redundancy pay must be determined based on the worker’s tenure and position after consultation with the Consultative Council of Labour and Employment (CCTE).
