Employment laws and regulations in Comoros

Understanding and adhering to employment laws and regulations is crucial for global businesses operating in Comoros. As you expand your operations into this market, it is essential to be well-informed about the legal framework surrounding employment contracts and working conditions.

In Comoros, you have the flexibility to establish either fixed-term or indefinite contracts with your employees. A trial period of up to six months can be agreed upon, allowing you to assess the suitability of the employee for the role. During the trial period, it is important to provide a written contract outlining the terms and conditions.

To maintain fair working conditions, the legal working time in Comoros should not exceed 40 hours per week, except in exceptional circumstances. In cases where overtime work is necessary, such as urgent or seasonal projects, it should not exceed 20 additional hours per week. Rest periods are also protected by law, ensuring that women and young workers are entitled to a rest period of 12 consecutive hours daily, while all workers must have a weekly rest period of 24 consecutive hours, usually observed on Sundays or Fridays.

Employment termination in Comoros

Terminating employment contracts requires careful consideration of the legal framework in Comoros. As a responsible global business owner, it is crucial to be aware of the policies and regulations surrounding employment termination to ensure compliance and maintain a fair and equitable work environment.

In Comoros, you have the right to terminate an employee’s service if there is a valid reason related to their conduct or capacity to handle operations. However, it is important to note that termination based on factors such as trade union activity or membership, nationality, color, race, social origin, gender, family responsibilities, pregnancy, marital status, religion, political opinion, or exercising a mandate to represent workers is strictly prohibited.

Comoros’ employment laws also protect employees who make good faith complaints against you for alleged law violations, report harassment, or have suspected or real HIV status. Additionally, absences for maternity leave, illness, or accidents certified by a physician cannot be grounds for termination.

When terminating an employee’s service without notice or before the period of notice has ended, you are required to provide remuneration for any salary and benefits the employee would have received for the remainder of the notice period. Severance and redundancy pay must be determined based on the worker’s tenure and position after consultation with the Consultative Council of Labour and Employment (CCTE).

Breedj understands the importance of navigating employment termination in Comoros with diligence and compliance. Our RPO services provide guidance and support to ensure that the termination process is conducted within the legal boundaries, minimizing the risk of legal disputes and maintaining positive employee relations.
