Employment laws and regulations in Burundi

Employment laws and regulations in Burundi are governed by the Burundian Labor Code, which outlines the rights and responsibilities of employers and employees in the country. Employee probation period in Burundi: Under Burundian law, the probationary period for employees cannot exceed 12 months. During this period, either the employee or the employer may terminate the employment contract without notice and without the need to pay any severance pay.

Working hours in Burundi: In accordance with the Burundian Labor Code, the normal working hours in Burundi are 8 hours per day and 40 hours per week. Employers are required to provide their employees with at least one day of rest per week, which is typically Sunday.

Overtime in Burundi: In cases of urgent or exceptional work due to a higher demand of work, the employer has the right to extend working time to a limit of 15 hours per week, and 150 hours per year. 

Every hour considered as overtime entitles the worker to the following compensation:

  • 35% for each of the first two hours worked after the legal weekly working time, or the weekly presence considered as equivalent;
  • 60% for each of the following hours.

 

Employment contracts in Burundi: Employment contracts in Burundi should be drafted in French, the official language of the country. The contract should include information about the employee’s job title, salary, benefits, and any applicable probationary period. It should also outline the terms of employment, including the duration of the contract, working hours, and any relevant policies or procedures.

Employment termination in Burundi

Termination of employment in Burundi is governed by the Burundian Labor Code, which outlines the rights and responsibilities of employers and employees when ending the employment relationship. Notice period in Burundi: The notice period for termination of employment contracts in Burundi is generally fixed by collective agreement. According to the Burundian Labor Code, the minimum length of the notice period for termination of an employment contract by an employer is:

  • One month if the employee has a seniority (work experience with the firm) of less than 3 years;
  • One month and a half (45 days) if the employee has a seniority of 3 to 5 years;
  • Two months if the employee has a seniority of 5 to 10 years; and
  • Three months if the employee has a seniority of more than 10 years.

 

Severance pay in Burundi: In accordance with the Burundian Labor Code, severance pay is not payable to a worker employed on daily wages, and when a worker is dismissed for gross negligence. In the case of individual dismissals, the rate of severance pay is as follows:

  • One average monthly salary for workers with a seniority of 3 to 5 years;
  • Two average monthly salaries for workers with a seniority of 5 to 10 years; and
  • Three average monthly salaries for workers with a seniority of more than 10 years.

 

It is important to note that these provisions may be subject to negotiation in collective bargaining agreements or individual employment contracts.
