Moving your employees to DRC

The Democratic Republic of the Congo (DRC) is a vast, resource-rich country located in Central Africa. With a population of over 100 million and an economy that has experienced growth in recent years, the DRC offers numerous opportunities for international businesses seeking to expand their operations.

The DRC is rich in natural resources, including copper, cobalt, diamonds, and gold. Additionally, the country has a significant potential for hydroelectric power generation, with the Congo River providing an ideal location for the construction of large-scale power plants. These factors make the DRC an attractive destination for businesses in the extractive industries and beyond.

Operating in the DRC comes with unique challenges. The country has experienced political instability in the past, and security concerns remain a key issue in certain regions. It is important for businesses to understand the local context and to have access to specialized knowledge and expertise in order to operate successfully in the country.

French is the official language of the DRC, and it is spoken by the majority of the population. Other widely spoken languages include Lingala, Swahili, and Tshiluba. It is important for businesses to be aware of these linguistic and cultural factors when establishing operations in the country.

Key immigration facts about DRC

Navigating the immigration process in the Democratic Republic of the Congo (DRC) can be complex and time-consuming. At Breedj, we understand the challenges that businesses face when relocating employees to the DRC, and we are committed to providing comprehensive support throughout the entire process.

Employment contracts in the DRC can be terminated by both the employer and the employee, but strict regulations govern the termination process. Any premature termination of a fixed-term contract will result in compensation being owed to the employee. The notice period for termination is 14 working days from the day after notification if the employer gives notice. This period increases by seven working days per full year of continuous service.

When it comes to income tax in the DRC, the Income Professional Tax (IPR) cannot exceed 30% of an employee’s taxable salary. Indemnities and allowances paid to an employee in relation to the termination of their employment contract are taxed at a rate of 10% IPR. Sums paid to casual employees are subject to IPR at a preferential rate of 15%. Incomes other than salaries are typically not subject to IPR, and foreign-sourced profits are not taxable in the DRC.

Value Added Tax (VAT) is also applicable in the DRC, with a standard rate of 16% on most goods and services. However, exports and certain other transactions are subject to a 0% VAT rate. It is important for businesses to understand the nuances of VAT regulations in the DRC to ensure compliance and avoid any potential legal issues.
