Employment termination in DRC

Employment termination policies in the Democratic Republic of the Congo are subject to strict regulations, and it is essential to comply with these regulations when terminating employment contracts. Failure to comply with local labor laws and regulations can result in significant penalties and damage to your organization’s reputation.

General termination of employment policies in the Democratic Republic of the Congo allow both the employer and the employee to terminate employment contracts, but this termination cannot be done freely and is subject to a strict regime. The notice period for employment termination is equal to 14 working days as from the day after the notification, where the notice is given by the employer. This period is increased by seven working days per full year of continuous service, counted from date to date.

Severance pay is only applicable to dismissals in open-ended contracts without just cause. The amount of severance pay cannot exceed 36 months’ salary of an employee’s last remuneration.
