The Democratic Republic of the Congo (DRC) has a complex set of statutory labor laws that companies must comply with when hiring employees. Breedj’s EOR services in the DRC ensure that our clients’ employees are fully compliant with local labor laws and regulations.
Employee Probation Period: The DRC’s labor laws allow for a maximum probation period of 1 month for an unskilled laborer without specialization and 6 months for other employees.
Annual Leave: In the DRC, the duration of annual leave must be at least one day for every month of effective service for workers over the age of 18. For workers under the age of 18, the duration must be at least one and a half days. The annual leave duration is increased by one day per month every 5 years of seniority in the same employer or replaced employer.
Maternity Leave: Upon pregnancy, women in the DRC have the right to suspend their work for 14 consecutive weeks, with a maximum of eight weeks post-pregnancy and six before childbirth. During this period, whether the child lives or not, the employee is entitled to two-thirds of her salary and continuation of the contractual benefits.
Paternity Leave: Fathers in the DRC have the right to a minimum of 2 days of mandatory paid paternity leave.
Sick Leave: The DRC’s labor laws provide for paid sick leave, with a maximum duration of 6 months.

The Democratic Republic of the Congo (DRC) has a social security system that comprises several branches, including the National Insurance Fund (Institut National de Sécurité Sociale or INSS), the National Office for Professional Training (Institut National de Préparation Professionnelle or INPP), and the National Office of Employment (Office National de l’Emploi or ONEM).
