Statutory labor laws in Mozambique

Employers hiring in Mozambique must adhere to local labor laws, which specify various requirements and obligations. The following are some of the statutory labor laws that companies should be aware of:

Probation Period: The probation period for mid-level and senior technicians, as well as employees engaged in leadership and management positions, is 180 days. For all other employees, the probation period is 90 days.

Annual Leave: Employees are entitled to paid annual leave, with the amount of leave increasing each year of employment. In the first year, employees are entitled to one day of paid leave per month. In the second year, this increases to two days per month. In the third year and beyond, employees are entitled to 30 days of paid leave annually.

Maternity Leave: Female employees are eligible for 60 days of maternity leave, which may begin up to 20 days before the due date. They are also entitled to up to 30 days of explained absences per year, which can be used for hospitalization of a child or other qualifying reasons.

Paternity Leave: Fathers are entitled to one day of paid paternity leave.

Sick Leave: Employees are eligible for up to 15 days of sick leave, or 5 non-consecutive days per quarter. If an employee needs more time off, they must seek approval from the health board. Social security will pay for up to 365 days of continuous sick leave for non-occupational illness or accident.

Social security in Mozambique

Social security contributions in Mozambique are payable monthly on all salaries, wages, regular bonuses, or other regular income, excluding meal subsidies. Employers contribute an amount equal to 4% of monthly salary, while employees contribute 3% of their monthly salary. The employer is responsible for withholding the employees’ contributions.

Foreign employees may apply for exemption from registration with the social security system provided that they are contributing to a similar system in their home country. However, it is essential to verify the applicability of this exemption on a case-by-case basis.
