General Termination of Employment Policies: In Zambia, a contract of employment may be terminated in the manner specified in the contract or as outlined in the Employment Code Act. If an employer terminates the contract, they must provide the employee with reasons for the termination.
Valid Reasons for Termination: A worker’s contract may not be terminated without a valid reason, such as those related to an employee’s capacity, conduct, or the undertaker’s operational requirements. Before terminating a contract due to poor performance or conduct, the employee must be given an opportunity to be heard.
Expiration of Employment Contracts: A contract of employment expires under various conditions, including at the end of the term, upon the employee’s death, when the employee reaches the retirement age, or through other lawful means.
Notice Period: Workers are entitled to termination notice or payment in lieu of notice, except in cases of gross misconduct. The notice period is specified under the employment contract or, if not provided, follows the minimum durations outlined in Zambian law.
Severance Pay: The Employment Code Act of 2019 provides for severance pay in specific cases, including termination of fixed-duration contracts, redundancy, death in service, and medical discharge.
