Employment contracts are governed by Togolese labor law and must comply with local regulations. It is recommended to draft contracts in French, the official language of Togo, and to include specific terms related to compensation, benefits, and termination. The probationary period varies based on the job level, ranging from one month (renewable once) for workers, employees, and others, to six months (non-renewable) for managers and others.

Normal working hours in Togo are 40 hours per week, and overtime pay is required for any work exceeding this limit. The Interprofessional Collective Agreement mandates that employers pay overtime rates of 20% of the hourly wage for the first eight hours worked beyond 40 hours during the day, and 40% of the hourly wage for overtime beyond 48 hours. Additionally, workers who work on Sundays and holidays are entitled to overtime pay at a rate of 65% of normal pay.

Employment termination in Togo

Terminating an employment contract in Togo requires adherence to specific policies and procedures governed by local labor laws. At Breedj, we understand the importance of compliance with these regulations, and we work closely with our clients to ensure that all employment terminations are conducted legally and ethically.

Fixed-term contracts in Togo terminate upon the expiry of their term or upon termination by one of the parties. In cases of force majeure, agreement of the parties (provided it is recorded in writing), or heavy mistake, the fixed-term contract can be broken. Indefinite-term contracts may be terminated by the will of one of the parties, provided that the party initiating the termination gives notice.

The Collective Agreement specifies the minimum duration of the notice period, with one month for workers, employees, and the like, three months for supervisors, managers, and others, and five days for paid workers per hour. Employers are required to provide severance pay to employees with at least one year of continuous service in cases of dismissal on economic grounds. The amount of severance pay varies based on the years of continuous service, with a lump sum of 35% of the employee’s average annual salary during the employment period for one to five years, a lump sum of 40% for six to nine years, and a lump sum of 45% for ten or more years.
