Employment contracts in Nigeria are typically governed by the Nigerian Labor Act, which sets out the minimum requirements for employment contracts in the country. Best practices for drafting employment contracts in Nigeria include including basic terms such as job title, salary, working hours, and notice periods, as well as provisions for termination and severance pay.

Employee probation periods in Nigeria are typically between three to six months, and working hours are specified under the National Minimum Wage Act as 40 hours per week. Employers are required to provide one 24-hour rest period every seven days and a one-hour break per six hours of work. Overtime pay is required for employees who work more than 40 hours in a week, with payment set at one-half more than their hourly rate.

Employment termination in Nigeria

Employment termination policies in Nigeria can be complex and challenging to navigate, making it essential for global organizations to understand the key aspects of the Nigerian labor market before hiring local talent.

Under Nigerian law, the contract of employment may be terminated by either party at any time, with or without any reason, by giving the notification period provided in the contract. The required notice period for the termination of the employment contract depends on the length of service. Severance pay is not required by law in Nigeria, but payment owed to the worker must be made on or before the expiry of the notice period.

For a worker employed for three or more months, the employer is not liable to make any payment for a period during which the worker is absent from work with the leave granted by the employer at the request of the worker. Payment in lieu of notice is acceptable and is calculated by taking basic salary into account, excluding overtime and other allowances.

A court decision from 1967 states that summary dismissal is warranted if an employee’s conduct is of some grave and weighty character that it undermines the relationship of confidence which must exist between a master and a servant. Examples of such grave character include verbal or physical violence, assault on the employer, intoxication during working hours, stealing, fraud, bribery, or corruption.

The employer cannot terminate the employment contract without prior notice except in cases specified by the law. Otherwise, it is treated as a fundamental breach of the contract. Employers are required to give their employees notice of termination, and employees are required to give their employers notice of resignation.
