Statutory labor laws in Nigeria

Employers operating in Nigeria must comply with local labor laws to ensure a fair and equitable workplace. Below are some of the essential statutory labor laws in Nigeria that employers need to be aware of:

Employee Probation Period: While the law does not prescribe the maximum length of probation periods, in practice, probationary periods for employees typically last between three (3) and six (6) months.

Annual Leave in Nigeria: Workers are entitled to at least six working days of annual leave with full salary. The annual leave is increased to at least twelve working days for young workers (under sixteen), including apprentices. Workers must have worked for at least twelve months to qualify for annual leave.

Maternity Leave in Nigeria: Female employees are generally entitled to 12 weeks of maternity leave at 50% of pay.

Paternity Leave in Nigeria: Paid paternity leave is available in the Lagos and Enugu States for 2 weeks and 3 weeks, respectively.

Sick Leave in Nigeria: In general, employees are entitled to 12 days of paid sick leave per year.

Social security in Nigeria

Employers in Nigeria are required to provide social security benefits to their employees. The Nigerian Pension Reform Act of 2014 established a mandatory contributory pension scheme, which requires employers to contribute a minimum of 10% of an employee’s monthly emoluments, while employees contribute a minimum of 8%.

Monthly emoluments are defined as the total emoluments in the employee’s employment contract but cannot be less than the sum of basic salary, housing allowance, and transport allowance.
