Employment contracts in Mauritius should adhere to best practices and be drafted in English or French, the widely accepted languages for official documents in the country. The probation period, typically ranging from 1 to 3 months, can be extended if an employer is not satisfied with an employee’s performance, allowing for corrective measures and adjustments to be made.

Mauritian labor laws stipulates that the standard working week for every employee who is not a part-time employee will consist of 45 working hours, barring any special situations, and if an employee works 6 days in a week, one of those days should not exceed 5 hours, with compensation provided for 8 hours. Overtime becomes applicable if an employee works beyond 90 hours over a two-week period, and is paid at 1.5 times the usual hourly rate. Working on a public holiday or Sunday is considered overtime and is compensated at 2 times the standard hourly rate. Night shift workers are entitled to an allowance of 15% of their basic wage in addition to their normal day’s wage.

Employment termination in Mauritius

Understanding the nuances of employment termination policies in Mauritius is crucial for maintaining compliance and minimizing potential disputes. For employers with a minimum of 15 employees, or having an annual turnover of at least 25 million rupees, the Act imposes a duty to notify and negotiate with the recognized trade union or employees’ representatives prior to reducing the workforce.

In the absence of an agreement, prior authorization from the Redundancy Board must be sought. The Redundancy Board is required to complete its proceedings within 30 days from the date of notification by the employer, with any extension to be agreed upon by the parties. Termination of employment is not permitted within 30 days from the date of notification to the Redundancy Board or during any agreed-upon extension.

If an employer fails to adhere to these procedures, the workforce reduction shall be deemed unjustified. In cases where the Redundancy Board finds the reasons for the reduction unjustified, the employer must pay the employee a severance allowance at the rate of 3 months’ remuneration per year of service, or the Board may, with the consent of the worker, order the employer to reinstate the employee to their former position.
