Statutory labor laws in Tunisia

Understanding and adhering to the statutory labor laws of a country is a fundamental aspect of conducting business there. In Tunisia, these laws cover a range of areas, each carrying its own specifications and requirements.

For instance, the probation period for employees varies according to their role. Workers, or “agents d’exécution,” have a probation period of 6 months, while first line supervisors, or “agents de maîtrise,” have a probation period of 9 months. For executives, the probation period extends to a full year.

When it comes to annual leave, employees accrue one vacation day per month, leading to a total of 12 vacation days after a year of service. 

Maternity leave in Tunisia is up to 30 days of leave. To receive 66.7% of their daily earnings during this period, an employee must have contributed to social insurance for at least 80 days in the four quarters leading up to the birth. Paternity leave, on the other hand, allows fathers one day of paid leave within the first seven days following the birth of their child.

Sick leave benefits are also covered under Tunisian law. An employee can receive sickness benefits, equating to 66.7% of their daily average earnings for 180 days after a five-day waiting period, provided they have at least 50 days of covered employment in the last two quarters or 80 days in the last four quarters before the sickness began.

Social security in Tunisia

Tunisia has a comprehensive social security system that is financed by contributions from both employers and employees. As an employer, you are responsible for contributing 16.57% based on salaries, which is reduced to 0.5% for wholly industrial exporting companies. Employees, on their part, contribute 9.18% based on their salaries.
