Employment contracts are an essential part of the hiring process in South Africa, and it is important to draft them correctly to protect the interests of both the employer and the employee. Best practices for employment contracts include outlining the terms and conditions of employment, specifying the duration of the contract, and including details on remuneration, benefits, and termination clauses.

Employee probation periods in South Africa are not prescribed by law, but they must be reasonable given the circumstances of the job. Employers must ensure that the terms of the probation period are clearly communicated to the employee and that the employee understands their rights and responsibilities.

Working hours in South Africa are regulated by law, with the maximum normal working time allowed being 45 hours weekly. This is nine hours per day (excluding a lunch break) if the employee works a five-day week and eight hours per day (excluding a lunch break) if the employee works more than 5 days per week.

Overtime in South Africa is limited to a maximum of 3 hours per day or 10 hours in any one week. Overtime remuneration is paid at 1.5 times the normal rate, and 2 times the normal rate for Sundays and public holidays.

Employment termination in South Africa

Employment termination policies in South Africa are governed by the Basic Conditions of Employment Act (BCEA). According to section 37 of the BCEA, an employee may give notice of their resignation, or an employer may give notice of termination of employment, within the following time periods:

  • One week’s notice, if the employee has been employed for six months or less.
  • Two weeks’ notice, if the employee has been employed for more than six months but less than one year.
  • Four weeks’ notice, if an employee has been employed for one year or more.
  • Four weeks’ notice, if an employee is either a farmworker or a domestic worker who has been employed for more than six months.

 

These are the minimum time periods allowed by law, and the consent of both parties is required to agree to a shorter notice period. It is important to note that retrenched employees must be paid at least one week’s pay for each completed year of ongoing service.

In addition to the above notice periods, employers must follow due process when terminating an employee’s employment. This includes giving the employee an opportunity to respond to any allegations or grievances and providing a valid reason for the termination.

Severance pay is also an important consideration when terminating employment in South Africa. Retrenched employees must be paid at least one week’s pay for each completed year of ongoing service. However, the employer must pay the retrenched employee the amount specified in any policy or their employment contract, if that amount is larger.
