Employment laws and regulations in Senegal

When drafting employment contracts in Senegal, best practices recommend using French, the official language. This ensures clarity and mutual understanding between employers and employees. However, it’s also important to consider the probation period. In Senegal, a probationary period of three months for executives and one month for non-executives is permitted and may be renewed.

Senegal’s work week is generally 40 hours long. Nevertheless, overtime work is permissible up to 10 hours per week and up to 100 hours per year, subject to authorization by the labor inspection. Overtime is remunerated by an increase of 10% for performance between 41 and 48 hours per week, and by an increase of 35% for hours exceeding 48 per week.

Employment termination in Senegal

Terminating employment relationships can be complex, and it is essential to understand the relevant laws and regulations to ensure a fair and lawful process. In Senegal, termination policies are clearly outlined and must be strictly adhered to.

Employees can terminate a contract with 15 days’ written notice, although technicians must provide two months’ notice. Conversely, employers may terminate employees for just cause with written notice as follows: executives and similar positions require three months’ notice, while monthly paid white-collar workers, blue-collar workers, and permanent hourly, daily, or weekly paid staff require eight days to one month, depending on length of service.

Upon termination, workers are generally eligible for severance pay, which varies based on the length of service and the collective bargaining agreement. For instance, workers receive 25% of their monthly wages during the first five years of service, 30% for the next five years up till the tenth year, and 40% per year after the tenth year.
