Employment termination in Mauritania

In general, contracts of employment with unspecified duration may be terminated at any time at the will of either party, provided that prior written notice is given by the party initiating the termination. This notification must clearly state the reason for termination.

The duration of the notice period varies depending on the seniority of the employee, with more senior employees being entitled to longer notice periods. It is important to note that employees dismissed for gross misconduct are not entitled to either notice payment or severance payment.

Fixed-term contracts, on the other hand, cannot be terminated prior to their expiry except in cases of gross misconduct, force majeure, or with the written consent of both parties. In cases of gross misconduct, a notice period is not required. In the event of unfair dismissal, an employee is entitled to receive compensation.

Severance pay in Mauritania is not subject to statutory requirements and is typically determined by collective or individual agreements.
