For instance, the Employment Act governs the terms and conditions of employment in Kenya, including employment contracts, probationary periods, working hours, and overtime.
Employment contracts in Kenya should be written in language easily comprehended by the worker, and express that the contract is for a probationary period of up to twelve months. Employment termination in Kenya is regulated by the Employment Act, which sets out the rules and procedures for terminating employment contracts. A worker may be terminated after serving due notice or paying in lieu of notice. The length of the notice period depends on the type of employment contract. For example, workers on daily contracts may be terminated at the end of the working day without prior notice, while workers during the probationary period must be given at least seven days’ notice (or payment in lieu of notice).
The length of the notice period may also be set in an employment contract by mutual consent of the employer and worker, provided that the period is longer than that provided by the Act. However, the notice should be written in language that is easily comprehended by the worker, and if necessary, explained orally in a language that the worker can understand.
It’s important to note that there is no provision for severance pay in legislation for reasons other than redundancy in Kenya. Redundancy refers to the loss of employment by involuntary means through no fault of a worker, involving the termination of employment at the initiative of the employer, where the services of a worker are superfluous.
Severance pay in Kenya, paid by the employer, is equivalent to 15 days’ basic wages for each completed year of employment.
